A Word of Caution

I'm repeating here a very thoughtful opinion piece on the Supreme Court's decision to allow President-elect Trump's lawfare case in NYC to continue. After reading it carefully, it seems to express just the right balance of jurisprudence and popular thought.

Much of the news lately regarding our national government has revolved around the Presidency and Congress. Understandably so. However, we must not forget to pray for the Supreme Court. They wield incredible power, which in America’s history has been used for both good and evil. With the great influence they hold in our nation, we must pray that they will continue to shift toward America’s founding principles and righteousness.

Last Thursday (January 9, 2025), the Court ruled 5-4 that the sentencing of Trump in New York for 34 counts of falsifying business records could go forward. Justices Roberts, Barrett, Sotomayor, Kagan, and Jackson ruled to allow it; Thomas, Alito, Gorsuch, and Kavanaugh said no. Thus, the sentencing occurred and, as presiding Judge Merchan had stated in advance, he issued an “unconditional discharge,” meaning there would be no fines or jail time.

Most conservatives believe that the Dems, including Judge Merchan, have been using the multiple cases against Trump as lawfare, attempting to keep him from winning the recent presidential election. After he won, in spite of their efforts, those on the Right believe Merchan’s actions continued in order to humiliate and demean Trump. Indeed, they now brand him as a felon. Most experts I have heard address Merchan’s case believe it was so unlawful, and his rulings from the bench were so egregious, that Trump’s conviction will unquestionably be overturned on appeal.

My purpose in mentioning this Supreme Court decision, however, is not to discuss the case; I’m certainly not qualified to do that. It is rather to comment on and pray for Justice Amy Coney Barrett. She has received tremendous criticism from those on the Right for her vote in this case. Chief Justice Roberts, while also touted as a conservative, has sided with the Left so often that it is not nearly as surprising when he does so. Barrett, on the other hand, was believed to be a staunch conservative when placed on the Court, and was loved by the Right. Since then, however, she has sided and voted with the Left more than once, to the bitter disappointment of many conservatives. This decision involving Trump is a case in point, and the criticism has been vicious. I feel a word of caution is in order.

Why Did She Vote As She Did?

I am certainly not a legal scholar, but in speaking with trusted conservative attorneys regarding Barrett’s decision, as well as listening to the insights of several more (including law professors), it appears that Justice Barrett took the typical course most Justices take on a criminal appeal such as this. In short, the Justices do NOT like to interrupt the normal legal process, preferring instead that cases run their normal course before getting to them. Understandably, I’m told, they make a great effort to honor “the process,” avoiding appearances - whenever possible - of dishonoring lower courts and judges.

Accordingly, the 5-Justice majority stated: “Trump’s state-court trial can be addressed in the ordinary course on appeal.” They added shortly thereafter that “the burden that sentencing will impose on the President-Elect’s responsibilities is relatively insubstantial,”(1) in light of the sentence Merchan was intending to impose. Again, in my layman’s terms, they were saying: Trump won’t be hurt by allowing this case to run its course all the way through the normal appeals process.

Those with whom I spoke and to whom I listened were NOT defending the majority decision, which of course included Amy Coney Barrett; they were simply explaining what they felt occurred. To quote one of them, who shall remain unnamed, “She took the ordinary course on a criminal appeal; it would be highly unusual in an ordinary case for the court to intervene at this stage. However,” he pointed out, “this is not an ordinary case. She treated the extraordinary as ordinary, and that is inappropriate. By attempting to treat this case no differently than others she missed the bigger point, which is that this case is very different from others. It involved a historic and unprecedented corruption of the criminal justice system to unjustly charge a former President of the United States – the most powerful nation in the world – attempt to imprison him, and interfere with his possible reelection. This case is truly extraordinary, and extraordinary cases call for extraordinary measures. Barrett seems to miss the forest for the trees. She is so focused on not treating Trump differently that she ignores the fact that he has already been treated differently.”

Another attorney made the point that it was inappropriate NOT to interrupt “the process,” because this process was flawed from the beginning. And whereas the highest court in America was given the opportunity to correct this by stopping the flawed process, it was ludicrous to not do so. In other words, by wrongly elevating the process of justice in this case, they allowed injustice to continue. As contradictory as it sounds, due process is not the goal; due process is to get us to the goal; it’s the means, not the end. And when the means is flawed, as it was in this case from the start, and the opportunity comes to correct that, it becomes irresponsible not to do so.

Again, I’m no legal expert, but that seemed logical to me.


Jesus showed us that it is indeed possible to so elevate a process, or even a law, that we make it sacrosanct. And in doing so, we sometimes sacrifice logic, wisdom, and even common sense. Ironically, the virtue of striving to meticulously follow a law can at times produce wrong decisions and outcomes. The Pharisees had a legal right under the law - some would argue a responsibility - to stone the adulterous woman brought to Jesus (John 8:1-11). According to Leviticus 20:10 and Deuteronomy 22:22, it seemed that both parties to adultery were always to be stoned. Not so, Jesus’ words and actions - His verdict - demonstrated. Think about it, the actual Giver of the law didn’t adhere to the law, the “process,” in this case. Instead, He said to the woman, “Neither do I condemn thee: go and sin no more” (John 8:11).

When refusing to condemn the woman, Jesus wasn’t condemning the law, either. He simply understood that the law being referenced, in and of itself, wasn’t the goal; it wasn’t the end of the matter. The purpose of the law was to keep evil practices from becoming acceptable in Israel (see Deuteronomy 22:22). Doing so, however, didn’t take precedence over repentance and God’s redeeming love.

Being a wise judge, especially at the Supreme Court level, involves properly understanding and interpreting the Constitution, then applying it with wisdom and reason in cases and laws. Doing this, while simultaneously avoiding the slippery slope of prioritizing/implementing one’s own ideals, is a daunting assignment, and is also a very weighty bestowed trust. That is why there are nine Justices on the Supreme Court. Their interpretations and reasonings vary, are at times inadequate, can be shaped by past paradigms and, sadly, can even be influenced by their personal preferences (i.e. legislating from the Bench). Therefore, due to the gravity of their role, the challenge of their responsibility, and their humanness, we rely on their collective reasoning.

Does Amy Coney Barrett now lean to the Left? I don’t think so. In my humble opinion she at times, demonstrating her humanness, falls prey to not adding wisdom to her virtue and knowledge, thereby making the “process” and/or “letter of the law” the ultimate goal.

What should be our position and response as intercessors?

Firstly, don’t speak evil of Justice Barrett (or any of the Justices), leveling accusations and word curses. Instead, pray for her.

Ask God to give her greater wisdom to operate alongside her tremendous intellect, knowledge, and good intentions…to reveal to her when being micro correct will result in being macro incorrect.

Ask God to give her a heart that submits fully to Him, and is immune to criticism.

Pray for the safety of her and her family.


Pray with me:

Father, You made very clear to us that we are to prioritize praying for our government leaders. We have no right to criticize them if we do not pray for them. Thank You for the changes that are occurring, for the godly individuals that are now functioning in our government. We ask You to give us more leaders who desire to follow Your will and ways.

You said in Isaiah 1:26: “I will bring back legislators who have integrity, people like your founding fathers—principled decision-makers. Then your city will be called honorable and just, a model of ethics, trustworthy, and strong” (The Voice Translation).

We pray for Justice Barrett, and all of our Supreme Court Justices. Give them wisdom and understanding as they apply knowledge. Their responsibilities are so great, the challenges so huge. Cause them to humble themselves and acknowledge their need for Your help in making sound decisions. Those who need to make changes and adjustments to their beliefs, please cause this to occur. Those who have hardened their hearts in ways that prohibit this, please remove them and give us Justices who fear Your name and honor Your ways. We ask all these things in Yeshua’s name. Amen.

Our decree:

We decree that God will give us leaders who are principled decision-makers, filled with integrity, and whose hearts honor Him.

This has been an interesting week, and not in the desirable way. So, since it's now over, let's move on.

Civility Unrest

Back in 1960, my working class parents voted different parties; my mom went democrat with JFK.  My father voted republican for Richard Nixon.  I remember sitting at the dinner table eating “Spaghetti-o’s” listening to my folks tease each other about “canceling” their votes.
 
Over the decades, my friends and family members supported a wide array of politicians and I never had a problem with any of them.  In fact, I’ve interviewed seven presidents and respect them all for their service to America.  I even enjoyed my brief time with George McGovern, about as left wing as they come.
 
But today I simply cannot understand how any intelligent American can support Bernie Sanders, who despises the United States and wants to burn down our traditions.  I believe Senator Sanders to be a truly dangerous man and those who would allow him power, are putting my family in jeopardy.
 
Let’s start with Sanders saying, during the debate in New Hampshire, that America is “racist society” from top to bottom.  In order to believe that, you have to accuse millions of Americans who hold responsible positions of actively persecuting blacks and other minorities.
 
To buy into Sanders’ irresponsible statement, you must also believe that the United States’ social system, by design and execution, denies the equal pursuit of happiness to millions of its citizens based on skin color.  
 
There is absolutely no factual basis to support that absurd point of view.  Yes, individual bias exists, but to allege it is national policy is a lie.
 
And Bernie Sanders embraces that lie.
 
The Senator also believes that private property is really federal property.  He promotes draconian taxation on corporations and wealthy citizens.  Beyond that, he wants to impose taxation on individual assets, acquired AFTER a citizen has paid income tax and other state financial demands.  This is his so called “wealth tax.”
 
To Sanders, it is a trade.  The federal government will pay for a citizen’s medical bills, dental expenses, eye glasses, hearing aids, elder care, child care, education from pre-k through college, and provide generous subsidies to low income Americans for every other life need.
 
In return, Sanders believes the federal government has the right to take whatever it wants from affluent citizens and private companies in order to pay for all the free stuff.  Sanders and Congress will decide how much of your pie will remain in the refrigerator. The feds will appropriate their “fair share,” and if you resist, you will be prosecuted.
 
So, if an American works hard, takes risks investing, and lives frugally in order to build long term financial security for his or her family, the feds would be able to seize those personal assets under the banner of “fair share.”
 
This frightening vision of Bernie Sanders would not only bankrupt the USA, it would punish every single American who has achieved economic success.  
 
Therefore, folks who support Sanders and his socialist/communist viewpoint, are enabling a dangerous point of view that would directly harm me and my family.  So, I can no longer engage those people.  I must strenuously oppose them.
 
If I wanted to live in Cuba, and have the state determine what I can and cannot possess, I’d move there.
 
There is little economic difference between Bernie Sanders and the tyrants in Havana.
 
That’s the truth.

A Thought About the Debate

We watched the debate as closely as our individual levels of nausea would allow. My take-away is this: if we were living in Old Testament times, I'd expect Ms. Clinton to be struck by lightning ... or at the very least, turned into a pillar of salt.

Just my opinion, folks; as always, your mileage may vary.

Thought of the Day

"There's no point in questioning authority if you aren't going to listen to the answers." I don't remember who said that, but the point is well-taken.

The problem with that is, when Americans finally woke up and started to listen, the answers didn't make any sense. 

And of course, when we point that out, we're labeled a bunch of tea-bagging, racist, homophobic, Constitution-loving, redneck, racist, illegal immigrant-hating, Sarah Palin/Glenn Beck/Rush Limbaugh-worshiping, Fox News-watching, bitterly-clinging-to-Bible-and-guns domestic terrorists.

I'm sure I left a few epithets out, but ... I don't care.


I no longer care whether someone on the left understands my point of view. The only thing that matters is whether they respect it, because it's increasingly clear that we have two completely disparate peoples sharing a common (although very porous) border.

Rogue Pastors Endorse Candidates; IRS Looks Away

From Politico comes this story:

A record number of rogue Christian pastors are endorsing candidates from the pulpit this election cycle, using Sunday sermons to defiantly flout tax rules.

Their message to the IRS: Sue me.

But the tax agency is doing anything but. Although the IRS was sued itself for not enforcing the law and admitted about 100 churches may be breaking the rules, the pastors and their critics alike say the agency is looking the other way. The agency refuses to say if it is acting.

At the same time, the number of pastors endorsing candidates in what they call Pulpit Freedom Sunday jumped from 33 people in 2008 to more than 1,600 this year, according to organizers, Alliance Defending Freedom. And this year, they’ve stepped up their drive, telling pastors to back candidates any Sunday up until the election, not just one Sunday as in past years.

[snip] At issue is the churches’ tax break as tax-exempt 501(c)(3) organizations. They don’t pay taxes, and donations to them can be deducted from contributors’ taxable income.

Several pro-freedom law groups have been telling pastors that the prohibition on political endorsement isn't really there, in the law. Nice to see some leaders stepping up and actually, you know, leading.

Post #4,000: Is Secession Inevitable?

This guy thinks so. He presents a thoughtful study based on three types of law. Go there if you wish, and think it over for yourself.

Here's an excerpt:

"The international law of secession is in the process of emerging at this very time. The U.N. Universal Declaration of Human Rights indicates that all people have the right to a country. A corollary of this is that no people should long be kept in nationless status, e.g., the Palestinians. A further corollary of this is that no people should long be kept in any subjugated status, such as by being citizens or subjects of a country from which they are alienated."

"The argument for secession under emerging international law might be strongest for Alaska. Geographically, the place is disjoint from the other states of the Union, making it an identifiable place. Furthermore, under their state constitution's explicit right of privacy, possession of small amounts of marijuana is a right; yet, the so-called federal government imposes the costs of its war on drugs onto the citizens of Alaska.

"Furthermore, the people of Alaska have been long frustrated in developing their natural resources because of the opposition by majorities in the "lower 48." Indeed, as a separate nation, Alaska might be the freest place in the world, with zero taxes because of its wealth in natural resources, well-established civil liberties, and a socially tolerant, live-and-let-live attitude among its people."

I don't know if this is inevitable, or desirable, and you must draw your own conclusions.

The Origin of "Left" and "Right"

I have often wondered why it is that Conservatives are called the "right" and Liberals are called the "left".  But then I read this verse in the Bible:

"The heart of the wise inclines to the right, but the heart of the fool to the left." Ecclesiastes 10:2 (NIV)

Thus sayeth the Lord. Amen.
Can't get any simpler than that.

"Are Americans Living in a Police State?"


The thing about a police state is that it tends to creep up on you. One day you think the Bill of Rights is intact and the freedoms you take for granted are intact, but the next day you find out that under the National Defense Authorization Act (HR 1540), signed into law by President Obama on December 31, 2011, you can be arrested and detained without recourse to an attorney or the courts.

HR 1540 kills the concept of Habeas Corpus by permitting the detention of U.S. citizens without trail. In 2009 the National Emergency Centers Act, HR 645,  was introduced for the establishment of “internment camps.” I have not been able to determine if it was passed and signed into law, nor have I found any explanation why the Congress of the United States either passed or even considered these laws.

The 2001 Patriot Act was justified as a response to 9/11 and revised in 2012. It gives the government unprecedented powers of surveillance and enforcement in the name of deterring terrorism.

One of Obama’s many executive orders permits him to “commandeer” all domestic U.S. resources, including food and water supplies, energy productions, and transportation, even in times of peace, with no congressional oversight. On March 16, 2012, the National Defense Resources Preparedness EO expands on a law from the 1950s as the Cold War was heating up and there were fears of a conflict with the Soviet Union.

President Obama, obsessed with leaks to the press, has now turned the entire federal government into a workplace where employees are expected to report “suspicious activity” of their co-workers. Failure to do so could result in penalties including criminal charges. Though figures differ, by 2010 there were an estimated 2.5 million full-time federal employees.

According to an article by Jonathan S. Landay and Marisa Taylor, two reporters for McClatchy newspapers, the October 2011 executive order mandating the program is “based on behavioral profiling techniques that are not scientifically proven to work, according to experts and government documents.” The program, deemed flawed, “could result in illegal ethnic and racial profiling and privacy violations.”

As Americans have been learning in airports across the nation, the Transportation Security Authority routinely engages in profiling and highly intrusive physical “pat downs” that many find humiliating.

In 2011, the TSA’s “VIPR teams” conducted an estimated 8,000 unannounced security screenings at subway stations, bus terminals, seaports, and highway rest stops in which Americans were required to show some proof of identity. This is the same administration that opposes voter ID, but not when the police functions of the TSA are concerned.

In bits and pieces, news of activities at the Department of Homeland Security (DHS) has been reported and, when the dots are connected, some very scary conclusions can be reached. Why has DHS purchased 1.6 billion bullets as of March of this year? That is reportedly twenty times more than the amount of bullets expended in the Iraq War. Why is the DHS reportedly sending thousands of heavily armored vehicles and combat gear to cities and towns around the nation for use by police forces that are increasingly being militarized?

One can find a list of actions by the Obama administration that, together, portray preparations for the implementation of a police state as Americans are detained, as per a DHS report, because they are deemed to be potential terrorists because they hold beliefs and ideologies that include:

# “being fiercely nationalistic (as opposed to international in orientation)”

# “anti-global”

# “suspicious of centralized federal authority”

# “reverent of individual liberty”

# “believe in conspiracy theories”

# “a belief that one’s personal and/or national ‘way of life’ is under attack”

# “a belief in the need to be prepared for an attack either by participating in paramilitary preparations and training or survivalism”

# “impose strict religious tenets or laws on society (fundamentalists)”

# “anti-abortion”

And those are just some of the “suspicious” activities or beliefs that can get you hauled off to a detention camp without the benefit of a trial.

While there have been a handful of incidents where terrorist acts have been perpetrated by those inspired by Islam, they do not justify preparations that clearly suggest the Obama administration anticipates a perceived national uprising against the federal government. Indeed, a number of marches in Washington, D.C. are planned, including one on September 9.

The legislation that has been passed and the executive orders put in place suggest that there are plans in place to ensure that the implementation of a police state can be swiftly imposed on Americans, contrary to all the protections of the Constitution. Indeed, given their existence, are we not already living in a police state?
